Terms of use for PwC’s Compare Portal

With PwC’s Compare Portal (“Portal”), we, at PwC, are offering you the possibility of obtaining an in-depth overview of a growing number of global regulations across a variety of specialist areas, such as FATCA, CRS, KYC, Insurance Premium Tax, etc. Unless otherwise noted, the term “PwC” refers to the PwC network firm that you have an engagement with based on which you have received access to the Portal.

These terms apply to your use of the Portal. Each member firm in the PwC network (“PwC firm”) is a separate legal entity. For further details, please see www.pwc.com/structure.

These terms operate as a separate agreement between you as an individual user (“YouorUser”) and each PwC firm that provides You with access to the Portal.

Please read these terms carefully. By using the Portal You agree to comply with them. You may not use or continue to use the Portal unless You comply with these terms. You can access these terms on the Portal at any time through the Terms of Use link.

The following conditions of use apply:

  1. Access to the Portal is password protected. Users are required to choose a password with a minimum length of eight characters and in “cryptic” form. With “cryptic”, we mean a combination of letters (including at least one capital letter) and numbers or special characters. Within free modules of the Portal, Users will not be permitted to change the password which has been provided.

  2. The Portal requires registration of the User. The User may change his/her password at any time. Within free modules of the Portal, Users will not be permitted to change the password which has been provided.

  3. Registration to the Portal may require the User to submit personal data in the form of an email address and password. PricewaterhouseCoopers GmbH Wirtschaftsprüfungsgesellschaft (“PwC Germany”) will collect and process this data for the operation and administration of the Portal only and in accordance with the provisions of the German Federal Data Protection Act (“BDSG”). The User may revoke his / her consent to this storage and use of his / her data at any time, however, in such a case access to the Portal cannot be granted anymore.

  4. The User is not permitted to provide his / her access data to third parties. If a User has reason to believe that a third party has become aware of his / her password, he / she must change the password immediately. The User shall notify PwC about the potential disclosure of his credentials or the potential misuse of the User account without undue delay.

  5. The User must not copy, modify, work around, by-pass, reverse engineer or otherwise change the Portal or its underlying data, systems or software, or attempt to do so.

  6. PwC Germany will evaluate the Users’ log data for statistical purposes. PwC will create report statistics regarding the use of the Portal on an anonymous and aggregate basis and may provide these reports to internal functions, to other PwC network firms, as well as to its clients or potential clients.

  7. PwC Germany reserves the right to amend or update the information contained on this Portal at any time without separate announcement.

  8. PwC Germany shall use regularly updated technical measures to protect the Portal from unauthorized access by third parties.

  9. PwC would like to draw particular attention to the following points:

    • To the maximum extent permitted by law, each PwC firm excludes all implied warranties relating to the Portal and its content and accepts no responsibility or liability of any kind to You in connection with Your use of the Portal or its content.
    • Certain links on this Portal connect the User to other websites and content maintained by third parties over whom PwC and PwC Germany have no control. PwC and PwC Germany make no representations as to the content, accuracy, or any other aspect of information contained on third-party websites. The use of these information is at the User’s own risk.
    • PwC Germany endeavors to provide the Portal permanently, but no PwC firm makes any representations or provides any warranties to You about the availability or functionality of the Portal or its content (as either may be unavailable or discontinued at any time). Your access to the Portal may be suspended or discontinued at any time immediately and without warning, regardless of whether You comply with these terms.
  10. These terms were last changed on the date set out at the top of this page. These terms may be changed at any time by an updated version being published on the Portal. You can access the latest version of these terms at any time through the Terms of Use link. If You continue to use the Portal after a change is made, your continued use confirms You accept the change.

  11. In the event of any controversy or claim arising from use of the Portal, they shall be governed exclusively by the laws of Germany, excluding the provisions of private international law. The exclusive place of jurisdiction for any action or other legal proceedings against PwC arising out of, or in connection with, the information contained on this Portal shall be Germany, Frankfurt am Main.
